Terms and Conditions

By registering for, accessing or using the Service, you confirm that you have read, understood and accepted these Terms, together with our Privacy Policy and our Cookie Policy. Where you upload third parties’ personal data to the Service, our Data Processing Agreement (DPA) also applies and forms part of these Terms.

The Service is intended exclusively for professionals and businesses, not for consumers. If you use the Service on behalf of an organisation, you confirm that you are authorised to bind that organisation to these Terms.

Kalma is a platform for managing construction project deliverables, focused on tracking information delivery plans (TIDP/MIDP) in line with ISO 19650, with an optional integration with Autodesk Construction Cloud (ACC).

The Service is currently offered as an invitation-only early access programme. During the programme, use is free of charge and includes up to two (2) projects with unlimited drawings per account.

The Service is under development: features may change, be added or be withdrawn, and it may contain errors or suffer interruptions. We do not offer a guaranteed service level (SLA); we provide support on a best-effort basis at info@kalma.build. We recommend that you keep a copy of any information critical to your projects.

We may end the early access programme by giving you at least thirty (30) days’ notice by email, during which you will be able to export your data.

We will never charge you automatically. If we offer paid plans in the future, we will tell you the prices and conditions in advance, and you will only move to a paid plan if you expressly agree to it.

To use the Service you must create an account with accurate, complete and up-to-date information. You are responsible for keeping your credentials confidential and for all activity under your account.

You must notify us immediately of any unauthorised use of your account by writing to info@kalma.build.

You agree to use the Service lawfully and in accordance with these Terms. In particular, you must not: (i) access third-party systems or data without authorisation; (ii) infringe intellectual property rights; (iii) introduce malicious software; (iv) interfere with the operation of the Service or circumvent its limits; or (v) use the Service for unlawful purposes.

We may suspend or terminate your access if we detect use that breaches this clause.

The Service may integrate with third-party services such as Autodesk Construction Cloud and Google sign-in. Use of those integrations is subject to the respective third parties’ terms and privacy policies.

You are responsible for holding the licences, permissions and authorisations required for the data and files you connect to the Service. We are not responsible for the availability, accuracy or behaviour of third-party services.

The Service, its software, design, trademarks and content are owned by Tekio Consulting and Engineering Ltd or its licensors. You are granted no rights in them beyond a limited, non-exclusive, non-transferable licence to use the Service in accordance with these Terms.

You retain ownership of the data and content you upload or connect to the Service. You grant us a limited licence to host, process and display that data solely to provide the Service to you.

For third parties’ personal data that you upload as project content (for example, the names and email addresses of team members), you are the controller and we act as processor under the DPA. You confirm that you have a lawful basis to upload it. All other processing of personal data is governed by our Privacy Policy.

If you send us suggestions, ideas or comments about the Service, we may use them freely to improve it, without any obligation or compensation to you. We will never publish your feedback attributed to you without your permission.

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free or suited to your specific needs.

THE SERVICE IS A MANAGEMENT SUPPORT TOOL AND DOES NOT REPLACE PROFESSIONAL JUDGEMENT. The accuracy, completeness and validity of the information entered, and actual compliance with ISO 19650 and with any regulatory or contractual requirement of the project, are the sole responsibility of the user. We are not responsible for decisions made on the basis of information managed through the Service.

To the fullest extent permitted by law, Tekio Consulting and Engineering Ltd shall not be liable for any indirect, incidental, special, punitive or consequential damages, or for loss of profits, data or opportunities, arising from the use of or inability to use the Service.

Our total aggregate liability shall not exceed the greater of: (a) the amount actually paid by you for the Service in the twelve (12) months preceding the event giving rise to the claim; or (b) one hundred US dollars (USD 100).

Nothing in these Terms limits or excludes liability for wilful misconduct, gross negligence or any other liability that cannot be limited under applicable law.

You agree to indemnify Tekio Consulting and Engineering Ltd, its officers and employees against any third-party claim, damage or expense (including reasonable legal fees) arising from your breach of these Terms or from the content you upload to the Service.

You may close your account at any time by writing to info@kalma.build. We may suspend or terminate your access for breach of these Terms or for legal or operational reasons, notifying you where possible.

Before closure you may ask us for an export of your data. After closure we delete your data within thirty (30) days, unless the law requires us to keep it.

We may change these Terms. We will publish the updated version with its date and, if the changes are material, notify you by email at least fifteen (15) days in advance. Continued use of the Service after the changes take effect constitutes acceptance; if you do not agree, you may close your account.

These Terms are governed by the laws of the State of Israel. The parties submit any dispute to the exclusive jurisdiction of the competent courts of Tel Aviv-Yafo (Israel), without prejudice to any mandatory data protection rules applicable to you.
